Terms & Conditions

Thank you for visiting April Kinder Art. These Terms & Conditions apply when purchasing artwork, prints, commissions, gift vouchers or other products through my website.

I've tried to keep everything as clear and straightforward as possible. If you have any questions before ordering, please get in touch.

1. Orders & Payment

All prices are shown in pounds sterling (£).

Full payment is required when placing an order through the website. For commissioned artwork, payment secures your commission in my schedule.

Your order is confirmed once payment has been successfully received and you have received an order confirmation.

2. Pet Portrait Commissions

Every commissioned portrait is individually created by hand using the photographs and information you provide.

After ordering, you will receive instructions explaining how to send your reference photographs. Clear, well-lit photographs showing your pet's features and colouring will usually produce the best results.

I'm always happy to help you choose the most suitable photograph.

Please ensure that you have the necessary permission to provide and use any photographs you send to me as reference material.

3. Artistic Interpretation

My portraits are handmade pieces of artwork rather than photographic reproductions.

I aim to capture your pet's likeness, colouring, character and personality while retaining my own artistic style. Small variations between the reference photograph and finished artwork are therefore a natural part of commissioning an original piece.

Examples of my work can be found throughout my website and should give you a good indication of my artistic style before ordering.

4. Commission Timescales

Please allow a minimum of two weeks for a commissioned portrait to be completed.

Some pieces may take longer depending on the size, medium, complexity, level of detail and my current commission schedule.

If your portrait is required for a birthday, Christmas, anniversary or another particular date, please contact me before ordering and I will let you know whether your required timeframe is possible.

Any completion date I provide will be based on the information available at the time.

5. Your Finished Portrait & Approval

Before your commissioned portrait is dispatched, I will send you a digital preview of the finished artwork.

This gives you an opportunity to see your completed portrait and request any reasonable small adjustments.

Significant alterations that change the original brief, composition or reference photograph may not be possible once work has begun. If a substantial change is possible but requires significant additional work, any additional charge will always be discussed and agreed with you first.

6. Cancelling a Commission

Commissioned portraits are personalised and created specifically for you.

Once work on your bespoke artwork has begun, you will not normally be able to cancel the commission simply because you have changed your mind.

If you wish to cancel before work has begun, please contact me as soon as possible.

Nothing in these terms affects your statutory consumer rights, including your rights where goods are faulty, damaged or not as described.

7. Prints, Originals & Other Non-Personalised Products

For non-personalised products purchased online, please contact me within 14 days of receiving your order if you wish to exercise your applicable cancellation rights.

You then have a further 14 days to return the item.

Unless the item is faulty or I have agreed otherwise, returned products should be kept in good condition and packaged carefully for their return.

Personalised or custom-made products are treated differently, as explained in the Commission section above.

8. Damaged, Faulty or Incorrect Orders

I take great care when creating, checking and packaging every order.

If your artwork or product arrives damaged, faulty or is not what you ordered, please contact me as soon as possible and include photographs of the item and packaging where appropriate.

I will work with you to put things right.

Your statutory rights are not affected by anything contained in these Terms & Conditions.

9. Delivery

Available delivery options and applicable delivery charges will be shown during checkout.

Please make sure the name and delivery address supplied with your order are correct.

Original and commissioned artwork will be carefully packaged to protect it during transit.

If you believe an order has been lost or damaged during delivery, please contact me so I can investigate.

10. Original Artwork

Original artworks are individually created pieces and are therefore unique.

Any natural characteristics of handmade artwork or the materials used — such as subtle variations in texture, pencil marks or brushwork — form part of the individual piece and are not considered faults.

I make every effort to photograph my artwork accurately, but colours may appear slightly different depending on your screen or device.

11. Fine Art Prints

Prints are reproductions of my original artwork.

I take care to represent colours and details accurately; however, there may be small differences between the appearance of an image on your screen and the physical print.

The purchase of a print does not give the purchaser any copyright or reproduction rights.

12. Gift Vouchers

Gift vouchers may be used towards eligible purchases from April Kinder Art.

Each digital gift voucher contains a unique code which can be entered at checkout.

If the value of an order exceeds the available gift voucher balance, the remaining amount must be paid using another accepted payment method.

Where a purchase is less than the value of the gift voucher, any remaining balance will remain available for future eligible purchases, subject to the functionality and terms of the gift-card system used by the website.

Gift vouchers cannot be exchanged for cash except where required by law.

13. Copyright & Reproduction

Copyright in my artwork remains with April Kinder Art / April Kinder, even after the physical original has been purchased.

Purchasing an original, print or commissioned portrait gives you ownership of the physical item you have purchased. It does not transfer the copyright or give permission to reproduce, copy, commercially use or sell reproductions of the artwork.

Commissioned artwork may be photographed or scanned for my portfolio and may be shared on my website, social media or other promotional materials.

If your commission is intended as a surprise gift, please let me know and I will be happy to wait until after the relevant date before sharing it publicly.

14. Using Customer Photographs

Photographs supplied for a commission will be used as reference material for creating your artwork.

You are responsible for ensuring that you have permission to provide the photographs for this purpose.

I will not sell or commercially reproduce a commissioned portrait as a separate print product solely because you commissioned the original without addressing any additional permissions that may be required.

15. Website Images

Artwork, photographs, illustrations, branding and other original creative material displayed on this website are protected by copyright and may not be copied, reproduced, distributed or commercially used without permission.

Sharing links to my website or social media content is, of course, very welcome.

16. Pricing & Availability

Prices and product availability may change from time to time.

The price applicable to your purchase will be the price displayed when your order is placed.

Original artworks are unique and are therefore subject to availability.

I reserve the right to correct genuine pricing or listing errors. If an error affects an order you have already placed, I will contact you promptly and will not impose a different price without your agreement.

17. Privacy

Personal information provided when placing an order or contacting April Kinder Art will be handled in accordance with my Privacy Policy and applicable data-protection requirements.

Customer information will only be used where appropriate to process orders, communicate about purchases and operate the business.

18. Your Consumer Rights

Nothing in these Terms & Conditions is intended to exclude or restrict any rights you have under applicable consumer law.

Goods must be as described, of satisfactory quality and fit for purpose, and applicable consumer rights continue to apply to personalised and commissioned products.
